LIMITATION OF WARRANTY

EXCEPT AS SPECIFICALLY SET FORTH. HEREIN, THE SELLER HEREBY SPECIFICALLY DISCLAIMS ANY EXPRESSED WARRANTY AND ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE.

Seller shall not be liable to Buyer, its customers, successors, agents, employees or assigns, for any and all incidental and/or consequential damages rising out of or from the use of products sold by Seller to Buyer.

In the event a product sold by Seller to Buyers claimed to be defective, written notice of said defect must be delivered by Buyer to Seller within thirty (30) days of its sale to Buyer and said product must be returned to Seller, together with all packaging and Invoice for Purchase, within forty

(40) days of its sale to Buyer. No warranty shall extend beyond said date. after return to arid inspection by Seller, and provided said defect has not been caused by any other event or occurrence, Seller’s Sole Liability shall be to returned to Buyer the cost of purchase of said product and upon tender of said cost, Seller shall have no further liability to Buyer or to Buyer’s customers, employees, successors, agents, or assigns.

Unopened product parts sold by Seller to Buyer may be accepted for return by Seller, provided said product is returned by Buyer to Seller within thirty (30) days of its purchase, unopened, together with Buyer’s Invoice. All returned merchandise shall be subject to a ten (10) percent handling charge, prior to refund.

All returns require an authorization number or part(s) will be returned at customer’s expense.
